What is Tenancy at Sufferance?

Tenancy at Sufferance, also known as Holdover Tenancy, occurs when a tenant overstays their agreed-upon time limit. It happens when the owner did not request a renter to move out or hasn't decided to file for their removal. 

The tenant has no authorization to remain on the property past the agreed-upon duration since a new one is yet to be issued. However, they must have ceased making payments to be deemed tenants at sufferance in several states in the USA. 

Understanding Tenancy at Sufferance

Tenancy at sufferance happens when a tenant residing in a property legally continues to live there without the landlord's approval or an extension agreement. The sole distinction between a holdover tenant and a lawbreaker is that the renter obtained the tenancy legally but has outstayed the invitation.

Each jurisdiction may well have multiple legal classifications and methods for assessing whether a tenant is a lawbreaker if they stay on-premises for which they formerly had a rental contract.

Eviction actions are circumstances that might result in a tenancy of sufferance. This may occur if a resident's lease contract expires but cannot depart the property and the owner plans to lease the area to new residents. For example, the home or landowner may commence legal action to evict the renter from the house; however, the renter typically cannot be physically removed.

Whereas the removal procedure is ongoing, the renter must follow the conditions of the lease. If they do not cover their costs according to the requirements of their previous lease, they may be evicted from the home. Before such a verdict is reached on an evacuation, it might take anywhere from 6 months or even a year. The landowner may have to tolerate such tenancy at sufferance for the duration of the rental period as far as the renter met their lease agreement responsibilities. The landowner may try to buy out another renter to leave the premises. This is a much more expensive purchase, but it will speed the settlement of the matter. If this buyout is approved, the homeowner's tenancy at sufferance will cease, and they will have to evacuate the property.

Practical Example

Bobby's lease does not specify how he can continue to control the home on a pay period basis just after the contract ends. In this circumstance, he is now in a tenancy at sufferance position if he continues at the flat just after the contract ends and his owner does not insist that he move.
